Homosexuality is a crime as per India Law!

By: Shaila D Touchton

Human sexuality has never been a part of public discourse in India. The law, enacted in 1861 and known as Section 377, makes "carnal intercourse against the order of nature with man, woman or animal" punishable by up to 10 years in prison. Homosexuality is not accepted in the Indian society because India recognizes only two sex i.e. male and females.
The treatment of homosexuals in India can be linked to Indian traditional society, which tends to be deeply conservative and disapproving of sex outside of marriage. Family is an important part of Indian culture, and the institution of marriage is seen as strengthening family values. As Indian society is very collective in its nature, this excludes the promotion of homosexual values. Homosexuality is illegal in India, and has been since the rule of the British. In the 1860s, Civil Servants considered it abhorrence and it was criminalized.
Female homosexuals are dealt with more severely than males in India. The Supreme Court of India decided that Indian society is not yet ready for homosexuality. In 86 nations, homosexual sex is considered a crime, and in seven countries it is punishable by death, according to the Foundation for AIDS Research, known as Amfar.
